Terms of Use

1. Agreement

These terms govern your use of https://getportfoliolens.com (the "Site"), operated by Portfolio Lens, Inc., a Delaware corporation ("we", "us"). By using the Site you agree to them. If you do not agree, please do not use the Site.

These terms also govern the Portfolio Lens application at https://app.getportfoliolens.com (the "Application"), which is operated by the same company. "Service" below means the Site and the Application together. Paid plans, when they exist, will add a subscription agreement covering fees, billing, and term — it will supplement these terms rather than replace them.

2. Not investment advice

Everything on the Site and everything the Application produces is published for informational and educational purposes only. None of it is investment advice. Nothing here is a recommendation, offer, or solicitation to buy or sell any security or to adopt any investment strategy, and nothing is personalised to your circumstances, objectives, financial situation, or risk tolerance.

Portfolio Lens, Inc. is not a registered investment adviser, broker-dealer, or financial planner, and no adviser–client or fiduciary relationship is created by your use of the Service. You should obtain your own professional advice before making any investment decision. See our investment disclaimer for the full statement, which forms part of these terms.

3. Example analysis

The Site publishes examples of research output. Each carries the date it was produced and refers to a specific point in time. Examples are not maintained, updated, or corrected for subsequent events, and must not be read as a current view on any company or security.

Forward-looking scenarios in that material describe possible outcomes and the conditions attached to them. They are not predictions, forecasts, or guarantees, and no representation is made that any scenario will occur.

4. Acceptable use

You agree not to:

• use the Site for any unlawful purpose, or in breach of any applicable law or regulation;
• attempt to gain unauthorised access to any part of the Site, its infrastructure, or any account or data that is not yours;
• interfere with the operation of the Site, including by circumventing rate limits or other protective measures;
• scrape, crawl, or systematically extract content at a scale or rate that degrades the service for others;
• submit an email address that is not yours, or otherwise impersonate anyone;
• reproduce, republish, or redistribute substantial portions of the content commercially without our written permission.

Reading, quoting with attribution, and linking are all fine and encouraged. We are describing bulk appropriation, not ordinary use.

5. Intellectual property

The Site and its content — text, analysis, design, and the Portfolio Lens name and marks — are owned by Portfolio Lens, Inc. or its licensors and are protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to access and view the Site for your own informational use.

Company names, tickers, and trade marks belonging to third parties are used for identification only. Their appearance does not imply any affiliation with, sponsorship by, or endorsement from those companies.

6. Subscriptions, trials and cancellation

Access to the Application is by paid subscription. Where a plan includes a free trial, we take your payment details when you start it and charge nothing until the trial ends; if you cancel before it ends, you are not charged. After that the subscription renews automatically for successive periods at the price shown when you subscribed, until you cancel.

You can cancel at any time from your account, without contacting us. Cancelling stops the next renewal and your access continues until the end of the period you have already paid for. Payments are taken by Stripe; we do not hold your card details.

7. Your account

You may create one account for yourself. You may not share your account with anyone else or let another person use your credentials. An account is for one named person.

You are responsible for keeping your credentials secure and for what happens under your account. Tell us promptly at insight@getportfoliolens.com if you believe someone else has access to it. We require multi-factor authentication on accounts with administrative access, and we may require it on any account.

You can delete your account at any time from within the Application. Deletion is scheduled seven days ahead and can be cancelled by you during that period; after it runs it is permanent. We may suspend or close an account that breaches these terms, and we will tell you why unless we are legally prevented from doing so.

8. Acceptable use of the Application

Section 4 applies to the Application as well as the Site. In addition, you agree not to attempt to access another member's data, to probe or test the security of the Service other than through a report to us, to automate access in a way that degrades it for others, or to extract its content in bulk for the purpose of building a competing product.

9. Availability

The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted, error-free, or free of harmful components, and we may modify, suspend, or discontinue any part of it at any time without notice. The Application is new software and we may change it substantially.

10. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

We do not warrant that any content is accurate, complete, or current. Analysis on this Site is produced with substantial machine assistance and may contain errors, including errors of fact, interpretation, and omission. See our methodology, which states these limitations plainly.

11. Limitation of liability

To the fullest extent permitted by law, Portfolio Lens, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or investment losses, arising out of or relating to your use of the Site — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility.

Our total aggregate liability arising out of or relating to the Site will not exceed one hundred US dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. Where that is the case, the exclusions and limitations above apply only to the extent permitted, and nothing in these terms limits liability for fraud, fraudulent misrepresentation, death, or personal injury caused by negligence.

12. Indemnity

You agree to indemnify Portfolio Lens, Inc. against any claim, loss, or expense (including reasonable legal fees) arising from your breach of these terms or your misuse of the Site.

13. Third-party links

The Site may link to third-party sites, including regulatory filings and source documents. We do not control them and are not responsible for their content, accuracy, or privacy practices.

14. Privacy

Our Privacy Policy explains how we handle personal information and forms part of these terms.

15. Changes

We may update these terms. The effective date at the top will change, and continued use of the Site after that date constitutes acceptance. Where a change is material, we will make reasonable efforts to give notice.

16. Governing law

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. The state and federal courts located in Delaware will have exclusive jurisdiction, and you consent to their jurisdiction and venue.

If you are a consumer resident in the European Union or the United Kingdom, this clause does not deprive you of the protection of the mandatory consumer-protection laws of your country of residence, or of the right to bring proceedings in your local courts.

17. Severability and entire agreement

If any provision of these terms is held unenforceable, the remainder continues in full force. These terms, together with the Privacy Policy and the investment disclaimer, are the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it.
